How VisitRecall handles your audio: Recording happens on your device. Transcription happens on your device using WhisperKit. Once your visit is transcribed, the audio file is deleted from your device. We never store audio recordings. We store only the resulting transcripts, summaries, and the health information you choose to keep — all encrypted in transit and at rest.
Welcome to VisitRecall. By accessing or using our website and services, you agree to be bound by these Terms of Service. VisitRecall, Inc. is a Delaware Corporation.
1. Acceptance of Terms
By downloading or using the VisitRecall application, you agree to these terms. If you do not agree, please do not use our services.
2. Description of Service
VisitRecall is a mobile application designed to help users record and understand their doctor visits. Our service includes:
- Audio recording of medical appointments (transcribed on-device via WhisperKit; audio is not stored)
- On-device transcription and AI-powered analysis of transcripts
- Health information organization and tracking
- Question suggestions and follow-up reminders
- AI-powered health question answering
- Family sharing of health information
- Next steps and to-do tracking
3. App Download
VisitRecall is available for download on the Apple App Store and Google Play Store. By downloading and installing the app, you agree to these terms and to the applicable platform's standard End User License Agreement (EULA).
4. User Responsibilities
You agree to:
- Provide accurate information when registering
- Obtain proper consent before recording any conversations
- Use the service in compliance with all applicable laws
- Not use the service for any illegal or unauthorized purpose
- Keep your account credentials secure
- Only share health information with family members who have your consent
5. Prohibited Use in Legal Proceedings
You may not use transcripts, summaries, or any other content generated by VisitRecall as evidence or in support of any legal claim, dispute, or proceeding against a healthcare provider. This includes, but is not limited to, medical malpractice claims, negligence actions, regulatory complaints, or any other litigation or administrative proceeding directed at a physician, nurse, hospital, clinic, or other healthcare professional or institution.
This restriction applies to all forms of content generated through the service, including AI-generated transcripts, visit summaries, and any derived materials. (Audio recordings are not retained by VisitRecall — they are transcribed on your device and immediately deleted, so there are no stored audio files to use as evidence.)
What is permitted: You may use your VisitRecall data for personal health management, communication with your healthcare team, insurance billing and claims disputes, and sharing with family members as intended by the service. Nothing in this section restricts your right to dispute a medical bill or insurance claim.
By using VisitRecall, you agree to this restriction. Violation of this provision constitutes a material breach of these Terms of Service and may result in immediate termination of your account.
6. Medical Disclaimer
VisitRecall is not a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information provided by VisitRecall.
AI-generated summaries, answers, and suggestions may contain errors or omissions. You should always verify important health information with your healthcare provider.
In case of a medical emergency, call 911 or your local emergency services immediately.
7. AI-Generated Content
VisitRecall uses artificial intelligence to provide transcriptions, summaries, and answers to health questions. You acknowledge that:
- AI transcriptions may not be 100% accurate
- Summaries are generated automatically and may miss important details
- AI answers to health questions are for informational purposes only
- You should review all AI-generated content for accuracy
- We are not liable for errors in AI-generated content
- AI responses do not constitute medical advice
8. Recording Consent
You are solely responsible for ensuring that you have obtained all necessary consents before recording any conversations using our app. Recording laws vary by jurisdiction, and it is your responsibility to understand and comply with applicable laws.
9. Family Sharing
VisitRecall allows you to share your health information with family members:
- You authorize family members you invite to view your shared health information
- You are responsible for managing who has access to your information
- You can revoke access at any time through the app
- Family members who access your information must also agree to these terms
- You should only share information with people you trust
10. Your Data Rights
You have full control over your data in VisitRecall:
- Access: View all your data at any time through the app
- Deletion: Permanently delete all your data using the "Delete All My Data" feature in Profile settings
- Portability: Export your transcripts and health information
- Control: Manage family sharing and revoke access at any time
How to Delete Your Data
To permanently delete all your data:
- Open VisitRecall and go to the Profile tab
- Scroll to "Your Data" section
- Tap "Delete All My Data"
- Review what will be deleted
- Type "DELETE" to confirm
This action permanently removes all your transcripts, summaries, questions, next steps, profile information, and family connections. (Audio recordings are not stored by VisitRecall — they are deleted on your device immediately after transcription.) This cannot be undone.
11. Account Termination
You may stop using VisitRecall at any time by:
- Deleting your data using the in-app "Delete All My Data" feature
- Signing out of your account
- Uninstalling the application
We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the service ceases immediately.
12. Intellectual Property
The VisitRecall name, logo, and all related content are the property of VisitRecall. You may not use our intellectual property without prior written consent.
You retain ownership of your transcripts and personal data. By using our service, you grant us a limited license to process your data solely to provide the service.
13. Limitation of Liability
VisitRecall is provided "as is" without warranties of any kind, either express or implied. To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the service
- We are not liable for medical decisions made based on information provided by the app
- We are not liable for errors in AI-generated transcriptions, summaries, or answers
- Our total liability is limited to the amount you paid for the service, if any
14. Indemnification
You agree to indemnify and hold harmless VisitRecall and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these terms.
15. Privacy
Your use of VisitRecall is also governed by our Privacy Policy, which is incorporated into these terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
16. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes via the app or through the contact information provided. Continued use of the service after changes constitutes acceptance of the new terms.
17. Governing Law
These Terms of Service are governed by the laws of the State of Delaware, United States. VisitRecall, Inc. is a Delaware Corporation. Any disputes arising from these terms or your use of the service will be resolved in accordance with Delaware law and shall be subject to the exclusive jurisdiction of the courts located in Delaware.
18. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
